A Note about the Revised Ordinance
The revised ordinance includes new language about delinquent surcharge fees and about those in violation of the ordinance. Please note that being delinquent on surcharge fees is a violation of the ordinance. In the past, if a hauler was delinquent, the hauler would get a Notice of Violation and the hauler had an opportunity to make an appeal to the Board of Supervisors. Now the ordinance reads; "haulers that are delinquent on surcharges of greater than 90 days shall be subject to a Vermont Civil Violation pursuant to 24 V.S.A. §1974a of not more than $800". And it can be $800 a day for every day the violation persists. Those who receive a Vermont Civil Violation can still make an appeal, but now it will be made to the Vermont Judicial Bureau instead of the CVSWMD Board of Supervisors.
Another change is that in the past, when a hauler was late paying surcharge fees, CVSWMD staff would try to collect those fees. Now, haulers may not be notified of delinquency.

VT Information and Requirements for Waste Haulers
Food Scrap Collection
As of 2020, commercial haulers must offer separate collection of food scraps to nonresidential customers and to apartment buildings with four or more residential units and deliver them to a processing location such as a composting or anaerobic digestion facility. Commercial haulers are not required to offer collection of food scraps if another commercial hauler provides food scrap collection services in the same area and has sufficient capacity to provide service to all customers.
